Abstract: The current article deals with the issue of performative formulae which are used in different kinds of legal documents. The definition of the concept of a «performative utterance»is given and its main features are shown. The analysis of language material shows how legal performatives were comprehended and how they were used by people of different epochs. It is shown how the legal texts origi-nated in rituals of mutual obligation which are concluded in the form of oral agree-ments. The stipulation was, as we know, the main verbal treaty of Roman law. The modern texts are given to show the use of classic performative formulae, and a number of formulae in the documentary sets in accordance with grammar rules of language.
